PUBLIC HEARING
February 21, 2005
The public hearing for ZC2004-06 was opened at 7:00 p.m. by Vice Chairman Patrick J. Cavanagh. Zoning Resolution Amendment ZC2004-06 was initiated by the Zoning Commission on December 15, 2004. The amendment is known as the oil and gas wells and misc. amendment. The Geauga County Planning Commission voted to recommend approval of the amendment on January 11, 2005.
Mr. Cavanagh explained that this amendment primarily removes oil and gas well definitions and standards from the Resolution as that is now out of township government control.
Mr. Frank Kitko, zoning inspector, explained some changes to the amendment that will be made because as it was presented to the trustees, the riparian setback would have been eliminated in the index pages. Another change will be that mention of agricultural district should be eliminated as Auburn does not have an agricultural district, rather agricultural is not prohibited in any district in accordance with R. 519.21(B). It is suggested by Mr. Kitko that the definition of that section should be added to clarify the ordinance.
Since changes will be made by the trustees, a unanimous vote will be needed for passage.
Motion by Patrick J. Cavanagh seconded by Gene McCune to continue the hearing of ZC2004-06. VOTE: McCune, yes; Cavanagh, yes. The motion passed.
