The meeting was called to order at 7:30 p.m. by Chairman John A. Eberly.  All trustees were present. Mr. Willis Brown led the Pledge of Allegiance.

 

            Motion by John A. Eberly seconded by Patrick J. Cavanagh to approve the minutes as corrected of the regular session of the Board of Trustees of April 4, 2005.  VOTE: McCune, yes; Cavanagh, yes; Eberly, yes. The motion passed.

 

PUBLIC COMMENT:

            Mr. Jack Trethewey commented that all new flags will be needed at the cemetery for Memorial Day. The trustees thanked Sam Sotera and his wife for sewing up ragged edges on the flags throughout the year.

            Mr. Willis Brown questioned the tree removal done on Taylor May Road. He said that at his end of the road, removal was done back to the right of way but near Auburn Road, there are a lot of trees in the right of way not removed. The trustees will check on that.

            Dave Wilmot put letters in the mailboxes of Taylor May Road residents who will have fences moved prior to the reconstruction of the road. Any fences falling apart will not be replaced.

            Mrs. Silvernail and Mrs. Dimak, Valley Road residents, were present to complain about fishermen parking on the street and staying till 2:00 a.m. or 3:00 a.m.  The sheriff said it is up to Akron to determine if fishing is permitted and they will only respond in the case of a disturbance. Mr. McCune said that the road is a township road and parking is not illegal.

FIRESIDE ESTATES:

            Todd Petersen, attorney, was present. He expressed his regret at Auburn’s loss of Denis Squire. He discussed the variance hearing at the Planning Commission for Fireside Estate subdivision and that the stumbling block is 501(L) which is criteria for a road with a permanent turnaround or no other outlet.

            Mr. Eberly stated that we have procedures in place and the first step is to submit a plan to the zoning department. That has not yet been done. Mr. Kitko can only act on something that has been submitted.

            The trustees repeated that the issue is no access from Auburn Township to homes that would be in Auburn Township. This office is on record as being against it consistently for the last 12 years or so that it has been presented. The zoning inspector’s concern is meeting zoning regulations. He will act independently to following zoning on anything submitted to him.

 

REPORTS:

            Eugene T. McCune, Jr. His report was the Valley Road parking issue already discussed and the fences to be moved on Taylor May Road as already discussed.

            Mr. McCune reported that $4,211.89 has been collected during the month of March as inheritance tax from the estate of Grace Rybicki.

 

            Motion by Eugene T. McCune, Jr. seconded by John Eberly to transfer the $4,211.89 inheritance tax from the General Fund to the Land Acquisition fund. VOTE: McCune, yes; Cavanagh, yes; Eberly, yes. The motion passed.

 

            Patrick J. Cavanagh noted that he received a call from Adelphia Cable and that a contract extension letter was received from them.

 

            Motion by Patrick J. Cavanagh seconded by Gene McCune, Jr. to continue the franchise agreement with Adelphia Cable by signing the extension letter. VOTE: McCune, yes; Cavanagh, yes; Eberly, yes. The motion passed.

 

            Mr. Cavanagh mentioned his efforts to discuss a streetlight for Messenger and Route 44 as a joint venture with Newbury are continuing.

 

            John A. Eberly discussed Adam Hall. Things are moving right along and should be under roof at the end of next week. Pine trees at the south and east need to be removed. There are about 20 to 30 trees that are too close to the new extension of the building. Susan Plavcan will call to see if logging them is an option.  Mr. Tomsic will energize the septic sump. Mr. Eberly will check with Mr. Petersen and schedule the finish of Mr. Petersen’s work (installing light poles, installing catch basins, etc.)

            Mr. Eberly extends thanks to the township clerks in the county who called to offer their help.

 

            Susan Plavcan, Clerk, had purchase orders and warrants for signatures and a copy of the current financial report. Ms. Plavcan reported a need to move funds from the general fund to the road fund.

 

            Motion by John Eberly seconded by Patrick J. Cavanagh to transfer $60,000 from the General Fund to the Road Fund to account 2031-330-420. VOTE: McCune, yes; Cavanagh, yes; Eberly, yes. The motion passed.

 

            Ms. Plavcan reported on UAN raising prices from $579 a quarter to $915 a quarter. The fee schedule is now based on the township’s budgeted revenue plus a $50 per month hardware surcharge.

            Ms. Plavcan asked about getting blinds for several windows at the Admin. Bldg. She will get some pricing. Mr. Cavanagh asked her to try and replace missing window grids on the one front window.

            Ms. Plavcan presented pricing for a battery back-up for the clerk’s computer as now requested by the State auditors. She was given authorization to purchase a 90 minute battery back up.

 

            The trustees gave permission for Road Maintenance/Equipment Rental bids to be advertised in the News Herald.

 

            The trustees signed the Chip Seal contract with Ronyak Bros. Paving Co. and three witnesses also signed each contract copy.

 

            Mr. McCune set the last Monday in April as the first meeting date for the group that meets to plan the Memorial Day ceremony. The group includes Mr. McCune, John Reithoffer, Sam Sotera, and Jack Trethewey. They will meet at 7 p.m. at the Admin. Bldg.

 

            The Community Development Office will be awarding the Part B bid for Adam Hall (handicapped bathrooms and parking lot). The bids came in a little lower than anticipated and we may be able to extend the work somewhat.


            The trustees were given Auburn Volunteer Fire Department contracts to review. Mrs. Hawkins has again filed suit against the fire department. The current suit seems to be the same as the last one, which she dropped.         

 

PUBLIC COMMENT:

            Mr. Jeff Pulsford was asked how the Zoning Commission had decided to use their First and Second Alternate board members. He responded that they use Alternate #1 to fill the first absence and Alternate #2 in the case of two regular members being absent.

 

            April 30th is the day for our Roadside Pick up.
