PUBLIC HEARING
August 1, 2005
The public hearing for the proposed zoning amendment known as ZC2005-01 was called to order at 7:15 p.m. by Chairman John A. Eberly. All Trustees were present.
The proposed amendment is an updated Riparian Setback Map, Appendix E of our Zoning Resolution. It was initiated by the zoning commission on June 1, 2005. The county Planning Commission reviewed it and recommended approval on June 14, 2005
There was a question and discussion about oil and gas well drilling in a riparian area. The trustees believe one would have trouble getting permission to drill in a riparian setback. Even though the state is more lenient than the township was in regulating oil and gas wells, one would need a good reason to violate the setback.
Another question concerned flood plains and if they are included in the setbacks. The trustees stated that the map is for general purposes and is handled on a case by case basis. Our expertise is the Chagrin River Watershed Partners.
Motion by Gene McCune seconded by Patrick J. Cavanagh to close the Public Hearing on ZC2005-01. VOTE: McCune, yes; Cavanagh, yes; Eberly, yes. Motion passed.
