PUBLIC HEARING
October 17, 2005
The public hearing for the proposed zoning amendment known as ZC2005-02 was called to order at 7:15 p.m. by Chairman John A. Eberly. All Trustees were present.
The proposed amendment is a one paragraph update to the Fire Ponds section of the Zoning Resolution. It was initiated by the zoning commission on August 3, 2005. The county Planning Commission reviewed it and recommended approval on August 9, 2005
Mr. Eberly read the added paragraph which is, “The fire protection pond shall be constructed within the initial phase of said subdivision.”
A question asked was could a fire pond be built within a riparian setback. The trustees believe the answer is no due to the disruption it would cause; sediment reaction, etc. The Quadder property was discussed and it is believed that ponds that are already in existence may be used as a fire pond. A stream does not qualify as a fire pond.
Motion by Patrick J. Cavanagh seconded by Eugene McCune to close the Public Hearing on ZC2005-02. VOTE: McCune, yes; Cavanagh, yes; Eberly, yes. Motion passed.
